Apex Sim Racing Pit Pass Rewards Program - Terms of Service

1. Acceptance of Terms
   By participating in the Apex Sim Racing Rewards Program (“Program”), you agree to the following Terms of Service. Apex Sim Racing reserves the right to change, modify, or terminate these terms at any time without prior notice. Your continued participation in the Program indicates your acceptance of any changes to the terms.

2. Eligibility
   The Program is open to all registered users of the Apex Sim Racing website who are 18 years of age or older. Employees of Apex Sim Racing, its affiliates, dealers, subsidiaries, advertising and promotion agencies, and their immediate family members are not eligible to participate.

3. Enrollment
   To enroll in the Program, you must create an account on the Apex Sim Racing website. Once enrolled, you will automatically begin earning points based on your activity and tier status.

4. Tier Levels
   The Program includes three lifetime-spend tiers:

• Rookie Pass – $0 lifetime spend; earn 1x points per $1 spent

• Pro Pass – Unlock at $1,500 lifetime spend; earn 2x points per $1 spent with added perks

• Apex Pass – Unlock at $3,000 lifetime spend; earn 3x points per $1 spent with premium perks and access

Your tier status is based on your cumulative lifetime spend. Apex Sim Racing reserves the right to adjust tier thresholds or benefits at any time.

5. Earning Points
   Points can be earned through various activities including, but not limited to:

• Making purchases on the Apex Sim Racing website

• Referring friends

• Following us on social media

• Writing product reviews

The number of points earned for each activity and per dollar spent depends on your tier level. Point values and eligible activities are listed on the Program page. Points have no cash value and can only be redeemed for rewards specified by Apex Sim Racing.

6. Redeeming Points
   Points can be redeemed for discounts, products, or other rewards as specified on the Program page. The standard redemption rate is 2,000 points = $10 off. Redemption options and point requirements are subject to change at any time. Points cannot be transferred, sold, or exchanged for cash.

7. Expiration of Points
   Points will expire 12 months after the date they are earned, unless otherwise stated. Apex Sim Racing reserves the right to change the point expiration policy at any time.

8. Account Suspension or Termination
   Apex Sim Racing reserves the right to suspend or terminate your account and/or your participation in the Program if you violate these Terms of Service, engage in fraudulent activity, or for any other reason at our sole discretion. In the event of account suspension or termination, all points earned will be forfeited.

9. Changes to the Program
   Apex Sim Racing reserves the right to change, modify, or terminate the Program at any time without prior notice. This includes changing the number of points earned, the rewards available, tier thresholds, and any other aspect of the Program.

10. Limitation of Liability
    Apex Sim Racing will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your participation in the Program. This includes, but is not limited to, any loss or damage resulting from any changes to or termination of the Program.

11. Governing Law
    These Terms of Service shall be governed by and construed in accordance with the laws of the state in which Apex Sim Racing is headquartered, without regard to its conflict of law principles.
